SURVEILLANCE NOTICE
Notice to data subjects pursuant to Article 76(3) of the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, No. 163/2022; ZVOP-2) regarding the carrying out of video surveillance in the area, premises and facilities of the company Linasi, d.o.o. (Linasi Resort and the office building of the company Linasi, d.o.o.)

3. Purpose of surveillance
Video surveillance is carried out in order to ensure the safety of people and property in the area, premises and facilities of Linasi, d.o.o. (Linasi Resort and the office building of Linasi, d.o.o.) and in order to monitor entries and exits, all in accordance with the provisions of Articles 77(1) and 78(1) of the GDPR and the provision of Article 6 (1) point (f) of the General Data Protection Regulation – GDPR.
It is essential for the safety of employees, guests and their property, as well as the Company’s property, that video surveillance is carried out at all entry points to the hotel, as well as at all points where guests and employees can move freely. Due to the large surface area of the Linasi Resort, any other method of protecting people and property would be less effective.
For this purpose, we process the following personal data: a recording of an individual (image), location data, date and time of the recording.
After a thorough examination of all the options for ensuring security, it was concluded that the above objectives could not be guaranteed by less stringent measures. Linasi Resort has a large number of guests as well as external visitors on a daily basis, and given that the size of Linasi Resort is so large, Linasi, d.o.o. can only protect its property and the safety of people by means of a video surveillance system. Guests, especially those staying overnight, expect a high level of security. The collective interest of guests in a safe stay outweighs the possible interest of individuals to privacy.
Only common areas are under video surveillance, where multiple guests, visitors or employees of Linasi Resort have access (reception desk), while in hotel rooms, sanitary facilities, changing rooms, offices, etc., a higher level of privacy is ensured and there is no video surveillance in such premises.
Given that the office building of Linasi, d.o.o. is located at the Linasi Resort, i.e. right next to the hotel, the implementation of video surveillance at the main, side and rear entrances of the office building is also necessary to ensure the security of the employees and the property of Linasi, d.o.o. The video surveillance system will not, however, be introduced in the working areas of the office building. Linasi, d.o.o. has established that these objectives can be achieved by installing security cameras at all entry points to the office building.
4. Users of the video surveillance system footage
These are authorised persons in the Linasi, d.o.o. in accordance with the desion regarding the implementation of video surveillance. In the event that footage of a particular event or state indicates suspicion of a criminal offence, the police or other competent state authorities shall be informed.
5. Retention period for video surveillance system footage
We will not store your personal data collected on the basis of video surveillance for longer than 30 days. In case we need the information for the purposes of criminal or other official proceedings, we will store it for the entire duration of such proceedings. The information shall be forwarded to the competent national authorities (police, court, etc.) pursuant to the relevant decision of the competent authorities and in accordance with our statutory obligations.
Other information related to carrying out the surveillance and further processing:
- there is no further processing or particular impacts of processing in relation to the video footage;
- video footage is not transferred to third countries;
- the controller does not record sound in the scope of video surveillance;
- the events are monitored live, whereby access to live footage is available only to the controller’s authorised persons;
- there is no automated decision-making, including profiling;
- sound intervention is not possible.
6. Necessity to provide personal data or consent to video surveillance or recording
No personal consent is required due to the existence of a legal basis for video surveillance, an individual, however, has the right to refrain from entering the area, premises or facility where video surveillance is being carried out.
7. Notice of data subject’s legal remedies regarding the video surveillance system footage
Data subjects who recognise themselves in the video surveillance system’s footage or a data subject recorded by the video surveillance camera has the right to:
- acces the personal information, i.e., the right to inspect the video surveillance system footage that is related to the recorded person,
- rectify (blur – anonymise), delete, or restrict the processing of the video surveillance system footage,
- object to the processing of the video surveillance system footage,
- poportability of the video surveillance system’s data (a copy of the footage).
The individual shall submit his/her request for information to the e-mail address podpora@linasiresort.com or to the address Linasi, družba za upravljanje, d.o.o., Lačja vas 22A, 3331 Nazarje, Slovenia.
Linasi, d.o.o. shall satisfy a justified request within 1 month, except that in the case of complex requests or a large number of requests, the deadline for fulfilment can be extended for another two months. Linasi, d.o.o. shall inform the data subject of such extension and the reasons for it.
8. Right to submit a complaint regarding the processing of personal information
The data subject can submit a potential complaint related to the processing of personal information to the e-mail address: podpora@linasiresort.com or by post to the address: Linasi, družba za upravljanje, d.o.o., Lačja vas 22A, 3331 Nazarje, Slovenia.
In case you are not satisfied with the way we handle your complaint or you believe that the processing of your personal data violates data protection law, you have the right to lodge a complaint directly with the Information Commissioner.
